ORDER

In
response to notice issued by this Court, party in person Smt.
Manjulaben wife of Shri Karsanbhai Ambaram Parmar & Rajendrabhai
son of Karsanbhai Ambaram Parmar, both are remained present before
this Court. Learned advocate Mr. Parikh appearing for respondent
opponent.

The
first appeal is filed by claimants for enhancement of claim. Party
in person Smt. Manjulaben and Shri Rajendrabhai both are requests to
this Court that they are satisfied with award passed by Tribunal and
they have already received amount from opponent as awarded by
Corporation as well as they were also received compensation by
Workman Compensation Commissioner. Now, after this many years they
don’t want to proceed with appeal. Therefore, they requests to this
Court to disposed of this appeal.

This
statement is made by appellants before this Court. Therefore,
considering their request and looking to appeal memo. According to
my opinion, request made by both appellants is to be accepted, in
view of aforesaid back ground, and looking to date of accident i.e.
23/11/1979 taht more than 29 years have passed.

Accordingly,
this first appeals are disposed of as withdrawn by both appellants,
who have been remained present before this Court.
