Dated this the 7th day of February, 2011

                            JUDGMENT

The second petitioner is the present registered owner of a

motor car bearing registration No.KL- 40 B 8357. The first

petitioner was the former owner. The said vehicle met with an

accident on 6.11.2010. At that time it was driven by

Sri.P.M.Abdulla. Though he possessed a licence to drive transport

vehicles upto 27.2.2011 the licence to drive non-transport

vehicles was valid only till 16.5.2009. It appears that in view of

that the claim submitted by the second petitioner was not

considered. This writ petition was thereupon filed seeking a

direction to the first respondent, the insurer to settle the claim

expeditiously. When the writ petition came up for hearing today

Sri.Rajan P.Kaliyath, learned counsel appearing for the insurer,

submitted that pursuant to the directions issued by the insurer the

driving licence issued to Sri.P.M.Abdulla was renewed and

submitted to the insurer and that in view of the changed

circumstances the insurer will consider his claim for

reimbursement of the expenses incurred for repairing the car and

take a decision thereon expeditiously.

In the light of the said submission I dispose of the writ

petition with a direction to the insurer to process the claim

submitted by the second petitioner and take an appropriate

decision thereon expeditiously and in any event within two weeks

from today.
