2 22.7.2011 Learned counsel for the petitioner submits that he is
neither the driver, owner or khalasi of the truck by which the
goods were transported. It is further stated that the goods were
recovered from the premises which did not belong to the
petitioner. The only material that has come against him is that
someone has said that the petitioner was the person who has kept
the said goods in the premises concerned.
Call for the clear carbon copy of the case diary of
Purnea Sadar PS Case No. 295 of 2007 from the Court of the
Chief Judicial Magistrate, Purnea.
Put up this case on receipt of the case diary.
In the mean time, further proceedings in the aforesaid
case shall remain stayed subject to the fact that the charges have
not been framed in this case. In case the charges have been
framed, this case will automatically become infructuous.
