Keeping in view the several disputed facts brought on record
through the supplementary rejoinder affidavit filed today as
well as supplementary counter affidavit filed by Mr. Sanjay
Mohan, I am of the view that the matter needs detail enquiry
by the Secretary of Secondary Education, State of U.P. for the
reasons that first time before this Court it has been brought to
knowledge of this Court that some different persons have
been engaged by the Committee of Management against
whom the salary is being disbursed from the State Exchequer.
Let the matter be enquired by the Secretary of the Department
after providing opportunity of hearing to the parties
concerned, as the same is in the interest of the Institutions
concerned.
List on 15th of September, 2010. On that date the enquiry
officer shall file necessary affidavit along with enquiry report
before this Court.
