Learned counsel for the appellant submits

that due to the appellant having been sentenced to a

period below three years of imprisonment, he has

been allowed provisional bail by the trial-court

namely, Addl. Sessions Judge, F.T.C. No. IV, Siwan

in S.T. No.235 of 1996. Prayer is made for

confirming the provisional bail.

Accordingly, the provisional bail granted to

the appellant Manoj Kumar is confirmed till the

disposal of the appeal.

The realization of fine imposed on the

appellant shall remain stayed till the disposal of

appeal.
