02 27.01.2011 Both the above stated criminal miscellaneous cases have

arisen out of Patliputra P.S. Case No. 189 of 2010 registered under

Sections 406, 420, 34 of the Indian Penal Code and accordingly, both

the above stated criminal miscellaneous cases are being disposed of by

this common order.

Allegedly, petitioners being Directors of one Krish

Foundation, collected huge amounts from unemployed persons on

pretext to provide job to them but subsequently, the aforesaid persons

did not get the assured job.

Learned counsel appearing in Cr. Misc. No. 44650 of

2010 submits that petitioner is not Director of aforesaid Krish

Foundation and, as a matter of fact, petitioner is an employee of the

aforesaid Krish Foundation, which is a Society registered under Indian

Societies Registration Act. Learned counsel for the petitioner drew my

attention towards Annexure-2, which is memorandum of above stated

Krish Foundation and in the said memorandum the name of petitioner

in Cr. Misc. No. 44650 of 2010 has not been mentioned in the

capacity of official of the aforesaid Society.

Learned counsel appearing in Cr. Misc. No. 44949 of

2010 echoed the above stated submissions but he added that petitioner

got appointment letter in the aforesaid Krish Foundation and started

discharging his official duty but subsequently, he has been implicated

in this case. To fortify his contention, he drew my attention towards

Annexure-2 to Cr. Misc. No. 44949 of 2010.

Considering the aforesaid facts and circumstances as well

as submissions of the parties both the above named petitioners are

directed to be released on bail on furnishing bail bonds of Rs. 10,000/-

(Ten Thousand) with two sureties of the like amount each to the

satisfaction of Chief Judicial Magistrate, Patna in connection with

above stated Patliputra P.S. Case No. 189 of 2010.
