Prayer in the present petition is for grant of regular bail to the
petitioner, who is accused in FIR No. 514 dated 22.12.2008, registered under
Sections 302/120-B/34 IPC at Police Station, Civil Lines, Sonepat.
Learned counsel for the petitioner submitted that the petitioner in the
present case has been falsely implicated merely on the statement of the co-
accused,which is otherwise not admissible. The petitioner cannot be implicated
even with the help of Section 120-B IPC, as there was no criminal conspiracy, as
alleged.
On the other hand, learned counsel for the State submitted that there
are specific accusations made to the petitioner in the statement of the co-accused.
It is a fact that the petitioner was also involved in property dealing with the parties
involved in the present case. The murder was also committed on account of a
dispute of property. The petitioner had actively helped the main accused in
committing the crime.
After hearing learned counsel for the parties and considering the
seriousness of allegations against the petitioner, I do not find this to be a fit case
for grant of bail to the petitioner at this stage. The allegation against the petitioner
is that he had pointed out to the main accused the presence of the deceased in the
hospital and further helped him in running away from the spot in the car.
Accordingly, the present petition is dismissed.
