1. Learned counsel for the petitioner submitted that even the
admitted amount of rent for the property, which has been
taken on hire basis by the respondents, is not paid since
long. The dues are not paid since the year, 2003 onwards. It
is also submitted by the learned counsel for the petitioner
that though the total admitted amount, not paid, is a very
meager figure for mightiest body i.e. for the State, which is
approximately Rs. 1,19,750/-, the same is not paid, only on
the ground that the high-ranking officers are not releasing
the fund, but, they are releasing funds for several
ceremonies etc.

2. Smt. Abha Kusum Tirkey wife of Sri G. Kujur, Deputy
Director, Primary Education, Human Resources
Development Department, Government of Jharkhand,
Ranchi, has been promptly called upon by the learned
counsel, appearing on behalf of the State, in the interest of
justice, and very promptly, an additional affidavit is also filed
during course of the day. I appreciate the painstakingly
assistance, rendered by the Government Advocate and I also
appreciate the officer concerned, who is present in the Court,
who has extended all her assistance by exercising powers for
filing affidavit before this Court. Paragraph no.4 of the said
affidavit reads as under:

“4. That it is stated and submitted that the admissible
dues which is payable to the petitioner will be paid to
him within a week from today.”

3. Thus, learned counsel for the petitioner is not much
ventilating his grievances, as within a week’s time the
admitted amount will be paid to him.

4. In view of the aforesaid submissions and looking to the
affidavit, filed during course of the day, by the respondents, I
hereby direct respondent no.3 to make the payment of the

admitted dues, towards rent, to the petitioner, within a
period of two weeks from the date of receipt of a copy of the
order, passed by this Court. Necessary amount will be
released by respondent no.3, for payment to the petitioner,
through respondent no.5. I expect that this order will be
complied with in its true spirit and letter, without leading or
leaning towards a contempt.

5. The writ petition stands disposed of, in view of the aforesaid
directions.
