                         MANORANJAN KUMAR SINHA
                                      Versus
THE STATE OF BIHAR & ORS
                                    -----------

4 5.4.2011 The petitioners who are working in Agriculture

Department are aggrieved by the fact that the recommendation of

the Fitment Appellate Committee has been rejected by the Finance

Department.

The ground of rejection are two fold. It is firstly stated

that there is no equivalent post in the Central Government and as

such the sub committee of the cabinet has rejected the plea of the

petitioners and similarly situated persons for grant of equivalent

pay. The second ground is that there are two modes of entry on the

said post and as such, there is a difference in fixation of pay. The

petitioners’ case simply put is that they were working as District

Agriculture Officers in the pay scale of Rs.2200-4000/-. The

replacement of the pay scale of Rs. 2200-4000/- is Rs. 6500-

10500/-, whereas pay scale of Assistant Director is Rs. 3000-

4500/- and the replacement scale has been shown to be Rs.6500-

10500/- which is the same replacement scale granted to persons

who were receiving basic pay scale of Rs. 2200-4000/-.

Mr. P.K. Verma, A.A.G. V prays for some time to

seek clarification on this point.
