2 17.03.2011 The petitioner is in custody in relation to Chiraiya

(Sikarahna) Police Station Case No 103 of 2005 for offence under

Sections 364A/34 of Indian Penal Code. The first information report is

against unknown wherein the driver alleges that while driving his master,

his wife and their servant, his master was kidnapped who was later, after

two days, released. Petitioner was one of the persons in whose house the

kidnapped person was kept. It is submitted that as per the Section 164 of

Criminal Procedure Code statement of the victim himself, the person, in

whose house he was kept, did not know about the kidnapping rather he

had helped him. It is further pointed out that the Zonal DIG, having

appreciated the fact, had opined not to chargesheet the petitioner, still on

the ground that he was named by the main accused Baleshwar Sahni, he

has been arrested.

Be that as it may, the petitioner abovenamed is directed to

be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten

Thousand) with two sureties of the like amount each to the satisfaction of

Judicial Magistrate, 01st Class, Sikarahna, East Champaran at Motihari in

Trial No 1139 of 2010 arising out of Chiraiya (Sikarahna) Police Station

Case No 103 of 2005 subject to the condition that petitioner’s son,

namely, Hebabullah Khan will be one of the sureties.
