learned counsel for the applicant that the case was transferred from one court
to another, therefore, the learned counsel for the applicant could not know the
actual date fixed in the matter and the case went in dismissal.

The ground appears to be a genuine one.

The order dated 29.4.2010 rejecting the application in default is recalled. The
application is restored to its original number.
