Heard learned counsel for the applicant, learned A.G.A. and
perused the entire record of the case.

The submission of learned counsel for the applicant is that the
accused applicant is ‘dewar’ of the deceased. Learned counsel
also submits that no overt act has been assigned to the accused
applicant. Learned counsel further submits that the allegations so
levelled against accused applicant are false and concocted and
the accused applicant is innocent and has falsely been implicated
in the present case. Learned counsel submits that here is no
evidence of abetment and cruelty. The accused applicant is in jail
since 16.3.2010 and there is no criminal history of the applicant,
as averred in paras 18 & 20 of the bail application, which is
admitted by the State.

Considering the overall aspects of the matter, I hereby provide
that the applicant be released on bail in Case Crime No.195 of
2010, under Sections 306, 498-A IPC, P.S. Gosainganj, District
Sultanpur, on his filing a personal bond and two sureties each in
the like amount to the satisfaction of the court concerned/remand
Magistrate.
