Bail application filed by Md. Ishrafil @ Ishrafil Mian @ Guddu
Mian, is moved by Sri Shailendra Jit, learned counsel for the
petitioner and opposed by Sri Ravi Prakash, learned counsel for the
State.
Earlier bail prayer of petitioner rejected. However, it appears
from status report at flag’R’ that up till now only one witness
examined on behalf of prosecution. From perusal of deposition of
P.W.1, who happens to be informant of this case, I find that he has
not identified the petitioner in dock. He also stated that nothing
recovered in his presence. Petitioner is in custody from 08.02.2010.
Considering the aforesaid facts and circumstances of the case, I
allow this application and direct court below to enlarge the petitioner
on bail on his furnishing bail bond of Rs. 10,000/(Ten Thousand)
with two sureties of the like amount each to the satisfaction of A.D.J.
(F.T.C.), Koderma or its successor court, in connection with Koderma
(Telaiya) P.S. Case No. 623 of 2009 corresponding to G.R. No. 983
of 2009 (S.T. No. 125 of 2010).
