02. 08.09.2011 By order dated 09.12.2010 the application was

allowed. Now the Opposite Party No. 2 has filed the

application for modification of the order. Since this Court

has become functus officio after passing the order on

09.12.2010 this Court is unable to modify the order

impugned.

However, it will be open to the Trial Court at the

appropriate stage to look into the grievances of the

Opposite Party No. 2 if it considers necessary.
