Heard learned counsel for the petitioners and learned A.P.P. for the
Prosecution.
Petitioners have been made accused for the offence under Sections 25(A),
35 of the Arms Act, in connection with Chandrapura G.R.P.S. Case no.2 of 2011.
The case was instituted upon recovery of some partly manufactured arms
from a train and on the basis of some clue, subsequently the police raided the
place of one of the co-accused from where the tools for manufacturing arms were
recovered on 16.4.2011.
It is submitted that the petitioners have been made accused on the basis of
confessional statement. There is no recovery of the partly manufactured arms
from the petitioners, as is apparent from the FIR itself.
In the facts and circumstances of the case, I am inclined to release the
petitioners on bail. Accordingly, the petitioners Md. Mahfooz Alam and Md. Jamal
are directed to be released on bail, on furnishing bail bonds of Rs.10,000/-
(Rupees Ten Thousand) each, with two sureties of like amount each to the
satisfaction of learned Special Railway Magistrate, Dhanbad in connection with
Chandrapura G.R.P.S. Case no.2 of 2011.
