03 23.08.2011 Supplementary affidavit is filed on behalf of the
petitioner.
Heard learned counsel for the petitioner as well as
learned Additional Public Prosecutor for the State.
Allegedly, petitioner gave several dagger blows to
injured Saddam Hussain.
Learned counsel for the petitioner points out that the
statement of injured Saddam Hussain was recorded at P.M.C.H, Patna
and in the aforesaid statement he has specifically stated that co-
accused Md. Imtiyaz and Md. Izaz had given dagger blows to him
which is evident from perusal of Annexure-3 to the supplementary
affidavit. It is also pointed out by him that there are two injury reports.
One is said to have been issued by P.H.C., Paroo and another is said to
have been issued by P.M.C.H, Patna and both the above stated injury
reports are contradictory to each other.
Considering the aforesaid facts and circumstances as
well as submissions of the parties, let the petitioner be released on bail
on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two
sureties of the like amount each to the satisfaction of Sub Divisional
Judicial Magistrate, West Muzaffarpur in connection with Paroo P.S.
Case No. 49 of 2011.
