3. 8.11.2011 Learned counsel for the petitioners relies upon a
decision of this Court dated 6.10.2009 passed in CWJC No.
6575/2009 and a very large number of analogous cases
including CWJC No. 7500/2009 by which the cases of
similarly situated persons have been allowed and the said
order has been affirmed by a Division Bench in LPA No.
230/2011 and analogous LPAs.
Learned counsel for the State prays for and is
granted four weeks time to file the counter affidavit in the
matter.
Put up among top five cases in the main list on 7th
December, 2011.
