ORAL ORDER
RULE.
Ms.VS Pathak, learned A.G.P. waives the service of notice of rule
on behalf of the respondent No.1 and Mr.HS Munshaw, , learned
advocate appearing on behalf of the respondent No.3 – A.M.C..
Present
application has been preferred by the applicant – original
claimant, permitting her to prosecute the First Appeal as an
indigent person.
Having
heard Mr.Hiren Modi, learned advocate appearing on behalf of the
applicant, Ms.VS Pathak, learned A.G.P. appearing for the respondent
No.1 and Mr.HS Munshaw, learned advocate appearing for respondent
No.3 – A.M.C., and considering the averments made in the
application and considering the fact that the applicant –
original claimant was permitted to prosecute the claim petition as
indigent person and the said claim petition has been dismissed and
there is not change in circumstances, present application is
allowed. The applicant is permitted to prosecute the First Appeal as
an indigent person. Rule is made absolute accordingly. In
the facts and circumstances of the case, there shall be no order as
to costs.
