ORDER

At
the outset, learned APP Ms. M.L. Shah states that the order passed by
the learned Additional Sessions Judge is dated 07.11.2009; charge
sheet is filed in the case on 03.12.2009; and, the present
application is preferred by the applicant on 04.01.2010.

Considering
the aforesaid aspects, it becomes clear that the applicant has not
preferred an application before the Sessions Court after filing of
charge sheet.

In
view of the above, learned advocate Mr. Majmudar for the applicant
seeks permission to withdraw this application. Permission as sought
for is granted. This application stands rejected as withdrawn. Rule
is discharged.

On
instructions, Mr. Majumdar states that the trial has already
commenced, and, therefore, a direction may be given for quick
disposal of the matter. Looking to the peculiar circumstances of the
case, the trial Court is directed to dispose of the case as early as
possible, preferably within four months from the date of receipt of
the writ.
