learned Counsel Ms. Subhadra G.Patel for the petitioner and learned
APP Mr. A.J.Desai for the respondents.
Mr.
A.J.Desai learned APP states that as per the order passed by the
Secretary, Home Department, Sachivalaya, Gandhinagar,dated 22nd
June, 2007 the Government will consider the case of the present
applicant-convict prisoner for grant of parole leave under Section
433A of the Criminal Procedure Code after one year from the date of
passing of that order. Since the order is dated 22nd
June,2007, the said period of one year has already elapsed, and
therefore, according to the submission of the learned APP, the case
of the applicant is due for consideration and the Government will
consider his case and take appropriate steps.
In
view of the above, the learned Counsel for the petitioner does not
press this application. Application stands disposed of as not
pressed. D.S.permitted.
