Order
in Original dated 06.05.2008 passed by the Joint Director of Foreign
Trade refers to the letter dated 05.05.2006 wherein it is stated that
the Firm was asked to reguarlize the case by payment of customs duty
+ interest and Special Import License. Despite this fact, the
petitioner Firm had not regularized the case. Even in the
affidavit-in-reply filed by the Joint Director of Foreign Trade,
reference is made to the letter dated 05.05.2006. It is the case of
the petitioner that the said letter has not been received by the
petitioner. Even the respondents have also not produced the said
letter on the record.
In
the above view of the matter, the respondents are hereby directed to
produce the said letter dated 05.05.2006 on the record of this
petition and also mention the amount which the petitioner is required
to pay for regularization of the case.
