Heard learned counsel for the petitioner and the learned Standing Counsel.
Submission of learned counsel for the petitioner is that petitioner was
appointed against sanctioned vacancy and after due procedure as provided
under law. His further submission is that the vacancies were properly notified
and this Court in Writ Petition No. 3717 (S/S) of 2006 passed an order in the
case of one Raj Kumar Singh, for payment of salary who was appointed along
with the petitioner and was identically situated. The DIOS in pursuance to the
order of this Court dated 2.5.2006 ordered for payment of salary whereas the
petitioner has been deprived of the aforesaid benefit.
The ground has been taken that payment to make ad hoc appointment was not
vested with the committee of management. The said controversy has been
decided by this Court and the power to make adhoc appointment has been
upheld .
In these circumstances, the opposite parties are directed to make payment of
salary to the petitioner regularly.
