ORDER
1. Rule.
Learned APP Mr. L.R.Pujari appears and waives service of Rule on
behalf of the respondent- State.
2. The
present application has been filed by the applicant for extension of
temporary bail granted as per the order passed in Criminal Misc.
Application No. 12102 of 2010 dated 18.10.2010 and extended as per
the order passed in Criminal Misc. Application No. 13435 of 2010
dated 29.10.2010 for the reasons stated in the application.
3. Mr.
L.R.Pujari, learned APP has placed on record the report and submitted
that as per the said report the applicant has been granted temporary
bail on earlier occasions
and he has surrendered in time.
4. Having
heard the applicant who appears as party-in-person and learned APP
Mr. L.R.Pujari for the respondent – State and in the facts and
circumstances of the present case, the present application deserves
to be allowed.
5. As
per the doctor’s certificate, the applicant’s wife is to be operated
for polycystic overy. The laparoscopy was scheduled for 02.11.2010.
However, due to his son’s illness it had to be postponed. The
operation is scheduled for 14.11.2010. I have also perused the jail
report. For the foregoing reasons, the application succeeds.
Accordingly, it is partly allowed. The temporary bail granted as per
the order passed in Criminal Misc. Application No. 12102 of 2010
dated 18.10.2010 and extended as per the order passed in Criminal
Misc. Application No. 13435 of 2010 dated 29.10.2010 is hereby
extended till 20th
November, 2010 on the same terms and conditions.
6. The
applicant shall surrender to the jail authority on completion of the
aforesaid period i.e. on 20.11.2010, without fail. This would be the
last extension.
7. Rule
is made absolute accordingly to the aforesaid extent. Direct service
is permitted.
