JUDGMENT
Not admitted. Adv.Mr.Siby Mathew, Standing Counsel takes
notice on behalf of the respondents. The grievance voiced by the
petitioner who owns properties and is desirous of putting up of a high
rise building by the side of Maliakal M.A.Cherian Road is that on
account of encroachments into that road by 10 persons who owns
properties by the sides of that road, the width of the road has
become narrow down. I do not propose to go into the genuineness of
the petitioner’s grievance or the merits of the grounds raised since
Ext.P1 representation submitted by the petitioner is apparently
pending. I dispose of the Writ Petition itself directing the 2nd
respondent, the Secretary of the Municipality to conduct immediate
local inspection so that prima facie the correctness of the allegations
can be verified. If on local inspection, it is seen that the allegations
are prima facie correct, the 2nd respondent will issue notice to the 10
persons mentioned in Ext.P1, initiate proceedings and bring those
proceedings to their logical and without undue delay.
