D.Rajendran, learned counsel for the Anna University.
2. By consent, the Writ Petition is taken up for disposal.
3. Admittedly, in this case, the petitioner belongs to SC community and
got cut off mark and was sent a call letter for counselling to appear before
the fourth respondent on 19.7.2006 @ 11.00a.m. However, according to the
petitioner, the said call letter was received by him on 19.7.2006 at 1.00p.m. as
it is evidenced by the certificate issued by the postal authorities.
4. In view of the said delay delivery, the petitioner could not attend
counselling on the said date. However, as per a clause in the intimation
letter, if a candidate could not attend the counselling on the specified date
and time, he/she can attend on a subsequent date/time, during the counselling
period. But, the candidate can only opt for the seats available at that time
and cannot claim any seat as per original rank.
5. By virtue of the said clause, which is available in the call letter, as
admitted by the learned counsel for the University and subject to the conditions
contained therein, there is absolutely no reason to deny the said benefit to the
petitioner. In view of the same, the petitioner is permitted to attend the
counselling before the fourth respondent on 20.7.2006 before 4.00p.m.
6. Since according to the learned counsel for the petitioner, for
vocational course, which the petitioner has chosen, 4.00p.m. of today is the
last date, the fourth respondent is directed to permit the petitioner to
participate in the Counselling today i.e. on 20.7.2006 before 4.00p.m.
Accordingly, the Writ Petition stands allowed. No costs. Consequently, M.P.
(MD) No.1 of 2006 is closed.
