: HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)

Present
application is filed through Jail for temporary bail for a period of
60 days to construct his house on his land. It is stated in the
application that he has wife and three children in the family. A
certificate issued by Sarpanch of Tindalva Juth Gram Panchayat, Tal.
Rapar, Dist: Kachchh is enclosed. Learned Additional Public
Prosecutor, Mr.Shah, made available for perusal the jail remarks. No
adverse is noticed from the jail remarks. For the reasons set out in
the application and taking into consideration the jail remarks,
application is allowed.

1.1 Rule.

Mr. J K Shah, learned Additional Public Prosecutor waives service of
notice of Rule.

2. The
applicant is, therefore, ordered to be released on temporary bail for
a period of 30 (THIRTY) DAYS
from the date of his release on his executing a personal bond of
Rs.5,000/- (Rupees Five Thousand Only) before the Jail Authorities on
certain conditions that he will;

a) not
leave the State of Gujarat.

b) not
indulge in any illegal activity.

c) surrender
before the Jail Authorities in time.

3. Rule
is made absolute.
