ORAL ORDER

In
this group of petitions, the respective petitioner has prayed for an
appropriate writ, order and direction prohibiting the respondent
authorities from forcibly evicting the petitioners from the land
bearing Revenue Survey No.112 of Moje Halol, District Panchmahals
without complying with the order at Annexure-B to the petition. It
appears that the present Special Civil Applications are filed only on
the basis of the apprehension and there is no basis for such
apprehension that the respondent authorities may evict the
petitioners forcibly from the lands in question. Nothing is produced
on record to show that the respondents have tried to evict the
petitioners. It is also required to be noted that the present
Special Civil Applications came to be filed on 7th March,
2005 and no order is passed by this Court in the aforesaid petitions
and the present Special Civil Applications are placed on board for
hearing before this Court by the Registry in regular course. It is
not even the case of the petitioners that the respondents have
evicted the petitioners forcibly even today i.e on 7th
September, 2005. Under the circumstances, the apprehension on the
part of the petitioners that the respondent authorities may evict the
petitioners forcibly is not well founded and as such as has no basis
and hence, the present Special Civil Applications are dismissed at
the threshold.
