The petitioner is an accused in the case registered for the offence under
section 25(1-b)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submitted that the petitioner has been
falsely implicated in the case; he is the owner of the house; nothing
incriminating has been recovered from his possession; he has voluntarily
surrendered before the learned court below on coming to know about the case;
co-accused-Rajesh Pandey @ Chhotu Pandey, Chandra Shekhar Bharti @
Shekhar and Binod Kumar Chandrawansi have been granted bail by this Court ,
as stated in paragraphs-11, 12 and 13 of this application; petitioner is a local
permanent resident; there is no chance of his absconding.
Learned APP opposed the prayer for bail of the petitioner, but has not
disputed the contention made by the learned counsel for the petitioner.
Regard being had to the facts and circumstances of the case, the above
named petitioner is directed to be released on bail on furnishing bail bond of
Rs.10,000/-(ten thousand) with two sureties of the like amount each to the
satisfaction of learned Chief Judicial Magistrate, Dhanbad in connection with
Dhanbad (Dhansar) P.S. case no.1135 of 2009, corresponding to G.R. Case
no.4285 of 2009.
