16 04.07.2008 This is an appeal against the decree passed in a suit for

partition. Perused office report dated 01.07.2008. This appeal stood

dismissed against respondents no. 1 to 10 for non compliance of this

court’s peremptory order dated 16.10.1997. There are other

respondents (nos. 11 to 18) also under the appeal. In view of the

nature of claim this appeal cannot be proceeded against these

respondents in absence of respondents no. 1 to 10. Therefore, the

whole appeal has become incompetent and it is declared dismissed as

such.
