Background
1. The Applicant filed an RTI application dt.17.7.09 with the CPIO, PAO(DGHS) seeking the following
information:
i) A list of officers and employees, with their names and designations working in the office of
PAO(DGHS)
ii) Out of (i) above, a list of officers and employees with name and designations who have
been declared as DDOs along with copies of office orders declaring them as DDOs
iii) Details of work allotted to these DDOs along with copies of orders issued in this regard
iv) A photocopy of Diary Register and Dispatch Register for the period from 11.12.08 to
31.3.09.
On not receiving any reply, he filed an appeal dt.8.9.09 with the Appellate Authority reiterating his
request for the information.
Shri Dharitri Panda, Appellate Authority replied on 24.9.09 enclosing the desired information. He also
added that official concerned for the delay has been suitably reprimanded.
The Applicant filed a complaint dt.23.11.09 before CIC stating that based on the directions of the
Appellate Authority, he had deposited Rs.1000/ on 30.9.09 and till date documents have not been
supplied.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for August 2,
2010.
3. Shri Yogesh Kumar Meena, PIO & Dy.C.A and Shri Ashok Kumar A.O represented the Public
Authority.
4. The Complainant was present during the hearing.
Decision
5. The Complainant admitted to having received the information but was aggrieved that information was
received only after he had filed the first appeal.
6. The Commission accordingly directs the PIO to show cause as to why a penalty of Rs.250/ per day
should not be levied on the PIO for not responding to the RTI application within the stipulated period as
prescribed in the Act. He is directed to submit his written response so that it reaches the Commission by
2.9.10.
7. The Commission ordered accordingly.
