     Background

1. The Applicant filed his RTI Request on 24.07.2009, with the PIO Western Railway, New 

Delhi,   seeking     zerox  copies    of   the   tenders,   file   notings  besides  information   against 

miscellaneous issues. The PIO replied on 27.08.2009 providing point wise information. 

Against point No. 1 he stated that no such tenders as sought by the Appellant was floated 

by the office of the CMS­ADI. Being aggrieved with this reply, the Applicant filed his First 

Appeal on 24.09.2009 commenting on the replies furnished by the PIO. The Appellate 

Authority   replied   on   23.10.2009   providing   further   clarification   against   each   of   the 

Applicant’s   comments.   Still   not   satisfied,   the   Applicant   filed   his   Second   Appeal   on 

04.01.2010 indicating the missing information.  

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing 

for April 30, 2010.  

3. Dr.  S.S.  Rathode,  Chief  Medical Superintendent  represented  the Public Authority and 

was heard by video conferencing 

4. The Appellant and his Assistant Mr. R.C. Sharma were also present at the NIC studio. 

Decision
 

5. After   hearing   both   sides,   the     Commission   directs   the   PIO   to   allow   the   Appellant   to 

inspect all the relevant  files and to provide him copies of documents he requires. With regard to 

point   no.   4,   relating   to   statements     obtained   from   employees   in   connection   with   the   case, 
information may not be provided u/s 8 (1) (g) of the RTI Act, 2005, as disclosure  of the contents 

of the statements may endanger the physical safety of the  concerned individuals. 

6. The Appeal is accordingly disposed of.
