Background

1. The Applicant filed an RTI request dt.29.9.08 with the CPIO, DoT. He
requested for copies of notification that contain presidential orders issued to
Shri N.N.Murthy during the period Sept.1998 to May 2000.

i) appointing him to discharge the duties of AGM (Admn.) in the O/o
General Manager Telecom District, Visakhapatnam

ii) appointing him to discharge the duties of SS(TT) in the O/o General
Manager Telecom District, Visakhapatnam.
The CPIO replied on 27.10.08 stating that DoT has not issued any order for
appointment of Shri N.N.Murthy as AGM (Admn)/SS(TT) in the O/o GMTD,
Visakhapatnam. He also added that copy of the RTI application has been
forwarded to CPIO, O/o GMTD, Visakhapatnam. On not receiving a reply, the
applicant filed an appeal dt.14.11.08 with the Appellate Authority. On not
receiving any reply from the Appellate Authority, he filed a second appeal
dt.17.12.08 before the CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for March 13, 2009.

3. Both the Respondent and the Applicant were absent during the hearing.

Decision

4. The CPIO, BSNL, Visakhapatnam is directed to provide the information within
20 days of receipt of this Order and also to show cause as to why a penalty of
Rs.250/- per day should not be imposed on him for not replying within the
mandatory period as stipulated in the RTI Act.

5. The appeal is disposed off.
