Background

1. The Applicant filed an RTI application dt.11.7.08 with the CPIO, ECR, Hajipur.

He requested for information against 4 points including the number of
candidates who appeared for the examination held for promotion from Group
D to C in Hazipur on 16.6.08, the numbers who had passed and their marks.
The CPIO replied on 6.8.08. Not satisfied with the reply, the Applicant filed
an appeal dt.29.9.08 with the Appellate Authority. The Appellate Authority
replied on 29.10.08 providing further information. Aggrieved with this reply,
the Applicant filed a second appeal dt.10.11.08 before the CIC requesting for
answer sheets of all the candidates along with selection procedures and
guidelines.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 4, 2009.

3. Mr. N.S. Dohre, AFA/Admn. ECR, Bihar and Mr. Rakesh Kumar SO(A)
represented the Public Authority.

4. The Applicant was not present during the hearing.

Decision

5. The Respondent stated that in response to another RTI request dated 27.8.08
for the marks tabulation and a letter from Railway Board the CPIO had written
on 24.9.08 to the Appellant asking him to pay the requisite amount of money
for the photocopying charges for 80 pages for supply of information.
However, there was no response from the Appellant. Based on the
submission of the Respondent, the Commission observed that the Appellant
seems no longer interested in obtaining the information since he did not
respond to the request for depositing photocopying charges for 80 pages of
information. However, the Commission advises the Appellant to deposit the
amount of Rs.160/- to get the information by 10 July, 2009, after which date
no information will be provided.
