Background

1. The Applicant filed an RTI application dated 05.05.09 with the CPIO/BSNL,
Lucknow, wanting to know why his telephone connection is not being repaired
even after his having lodged several complaints. The CPIO replied on 25.05.09
stating that the connection was disconnected as there was balance payment of
Rs.712/- still to be paid by the Applicant. He also added that on part payment of
Rs/- 400 on 08.05.09 and on the payment of the remaining amount on 17.05.09
the connection was again provided. However once again since the Applicant failed
to make some balance payment the telephone was disconnected. He further
added that Mr. Kasim Ali and Mr. Omkar Nath are not responsible for the
disconnection. He suggested that the Applicant expedite payment of the balance
amount after which the connection will be provided again. Being dissatisfied
with the reply of the CPIO, the Appellant filed a Complaint before the CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing on 16th September, 2009.

3. Mr. Arun Kumar Garg, CPIO & DGM(A&P) and Mr. Dhan Patlal , SDE(RTI)
represented to the public Authority.

4. The Applicant was not present during the hearing.

Decision

5. The Respondents submitted that till date a payment of Rs 891/- against 3 bills is
pending from the Appellant and that the telephone was disconnected due to non
payment, on 26.08.09. However, the Appellant was provided the benefit of
Rs.1566/- in terms of waiver of rent to be paid during the disconnected period
i.e. from 27.08.08 to 17.05.09.

6. The Commission on perusal of the documents available observed that complete
information has been provided to the Appellant and advices the Applicant to
approach an appropriate forum for redressal of his grievance.

7. The appeal is accordingly disposed of.
