FACTS
:
The matter is called for hearing today dated 16.4.2010. The parties
have not appeared before the Commission. Hence, it has been decided to
dispose of the matter on the basis of material on record.
2. It is noticed that vide RTI application dated 21.8.2009, the appellant
had sought information regarding works executed under AE (E) Shri
Joginder Singh etc. This was responded to by Executive Engineer (E),
SJHED, CPWD, New Delhi, vide letter dated 17.9.2009. It was followed by
another letter dated 28.10.2009 wherein the appellant was asked to visit the
office of Executive Engineer (E), SJHED, on any working day for collection
of additional information.
3. It is, however, noticed that in the appeal memo, the appellant has
mentioned that he had visited the office of Ex-EN SJHED but neither
Executive Engineer nor AEN were found to be present there. He has
complained that complete information has not been provided to him till date.
4. As the parties have not appeared before the Commission, it is difficult
to determine whether or not complete information has been provided to the
appellant. However, ex-facie, the recital of the appellant appears to be
convincing. We, therefore, direct Executive Engineer (E), Safdarjung
Hospital, Electrical Department, CPWD, New Delhi, to re-visit the matter
and provide para-wise information to the appellant in 04 weeks time, failing
which he runs the risk of commencement of penal proceedings.
