Facts
arising from the Complaint:
Mr. Anand Moudgil had filed an RTI application with the PIO, Transport Department,
GNCTD on 29/03/2010. However, on not having received the information within the mandated
time, the Complainant filed a complaint under Section 18 of the RTI Act with the Commission.
On this basis, the Commission issued a notice to the PIO, Transport Department, GNCTD
18/05/2010 with a direction to provide the information to the Complainant and further sought an
explanation for not furnishing the information within the mandated time.
The Commission has received a letter dated 09/06/2010 from the SPIO/PCO, Transport
Department, GNCTD. It has been stated therein that the RTI Application was received on
31/03/2010 in his office and further forwarded to the PIO, STA Branch. Further stating that
information has been sent to the Complainant vide letter(s) dated 03/05/2010 and 31/05/2010
through deemed PIO, Assistant Secretary, STA Branch. Copy of the information provided
subsequently was also enclosed. The Commission further received a letter dated 08/06/2010
from the Complainant wherein it has been alleged that information provided with regard to
certain queries is not satisfactory. On Query No. 8 the PIO should have stated whether any
specific provision under the Motor Vehicles Act, 1988 provides for the STA to conduct meetings
with regard to deciding upon applications seeking grant of stage carriage permits. If no such
information is available on records the PIO should clearly state the same and provide a copy of
such statement to the Complainant. The Commission on perusal of the information has observed
that rest of the information provided is as per the provisions of the RTI Act.
Decision:
The Complaint is allowed.
In view of the aforesaid, the SPIO/PCO is hereby directed to ensure that information on
Query No.8 of the RTI Application is provided as mentioned above to the Complainant before
17/08/2010 with a copy to the Commission.
Further the Commission warns the deemed PIO/ Assistant Secretary, STA Branch to
ensure that information is given to applicants within 30 days as mandated under Section 7 (1) of
the RTI Act, 2005.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005
