Background
1. The Applicant filed an RTI application dt.6.9.08 with the CPIO, DoP, Gaya. He
stated that he had sent a representation on 6.5.08 regarding the irregularity
in the payment of the money order to Ms. One Ms. Minti Devi and the action
taken against the staff responsible for it. He stated that an inquiry was
conducted on 13.6.08 in which Ms. Minti Devi gave a statement in the
presence of Mr. Ayodhya Prasad Yadav. However, nothing is known of the
action taken. In this connection he requested for the following information: i)
copy of the statement given by Ms. Minti Devi ii) Will Minti Devi be paid after
depositing money from EDDA cum EDMC Kannausi BO to the unclassified iii)
who is responsible for the delay and what action will be taken against them
iv)when will Ms. Minti Devi be refunded the balance amount. The CPIO
replied on 3.10.08 stating that information sought does not relate to the
Applicant and therefore cannot be supplied. The Applicant filed an appeal
dt.13.10.08 with the Appellate Authority reiterating his request for the
information. On not receiving any reply, he filed his second appeal
dt.13.11.08 before the State Information Commission, Patna who transferred
the case to CIC vide letter dt.5.1.09.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for March 6, 2009.
3. Both the Applicant and the Respondents were absent at the hearing.
Decision
4. The Commission directs the CPIO to invite a submission under section 11(1)
from Ms.Minti Devi, orally or in writing regarding disclosure of information to
the Applicant and based on the submission to take a decision regarding
disclosure of information, before 25th of April, 2009.
5. The appeal is disposed off.
