ORDER
Background
1. The RTI Application dated 14.10.2010 was filed by the Applicant with the PIO, North Western
Railway, Jaipur seeking information against 5 points with respect to his representation to the Chief
Commercial Manager, N.W.Railway dated 22.9.2010. The representation related to his claim for refund
of excess charges which he had to bear. The PIO on 20.10.2010 returned the IPO which was not made
in the correct mode. The Applicant then filed his first appeal on 18.11.2010 enclosing the required IPO
once again. The Appellate Authority replied to the Applicant explaining the reasons for
having returned the IPO in the first instance and also informing him that his representation dated
22.9.2010 is not traceable in the office and requesting him to send another copy of the same so that action
can be taken. The Applicant instead of sending a copy of his representation as sought by the AA
approached the Commission with an appeal which was registered in the Commission on 1.11.2011.
Decision
2. During the hearing the Respondent stated that they saw the representation for the first time on
22.9.2010 when it was sent by the Commission to the PIO along with the hearing notice. The Respondent
also stated that had the Applicant provided him with the representation earlier when the Appellate Authority
had asked for it, action could have been taken much earlier. Nevertheless on receipt of the representation
along with the Hearing Notice, a reply was prepared on 4.5.2011 and the same is ready for dispatch to the
Applicant.
3. The PIO was directed to dispatch the reply that very day. He is further directed to provide any
clarification which the Appellant may wish to seek, within 15 days of receiving such details of missing
information from the Appellant.
4. The appeal is accordingly disposed of.
