Background

1. The Applicant filed an RTI application dt.9.6.08 with the CPIO, NR, New Delhi.

He requested for the following information:

i) How many Railway Passes have been issued to the staff of
NZRE/CTC/SY/LTD of A.gate, GZB branch since 1.1.01 as on date.

ii) Details may be supplied viz., Name of each person, his/her
designation, reason for traveling, Railway Pass number, Date of journey,
name of station from & to.

iii) Under those orders/instruction these passes have been issued

iv) Under which rule number of Indian Rail Establishment Manual these
passes have been issued

v) If found guilty then who will be held responsible for it.

On not receiving any reply, he filed an appeal dt.14.7.08 with the
Appellate Authority. The Appellate Authority replied on 4.8.08 directing the
Applicant to directly correspond with NZRE for the required information.
Aggrieved with the reply, the Applicant filed a second appeal dt.16.8.08
before the CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for May 25, 2009.

3. Mr. Mohar Singh, Sr. DMM cum PIO, Naresh Kumar, APO, Mr. V.R. Dubey
andMr. Anil Kumar, Clerk represented the Public Authority.

4. The Applicant was present during the hearing.

Decision

5. The Commission directs the CPIO to provide all the information sought in the
RTI request to the Appellant by 20th June, 2009 and also to show cause why a
penalty of Rs. 250/- per day should not be imposed on him for not providing
the information within the mandatory period. The response to this to reach
the Commission by 20th June, 2009.

6. The appeal is disposed off.
