Background
1. The Applicant filed an RTI application dated 10.02.09 with the CPIO/Deptt. of
Posts, Kolkatta seeking information about the following including reason for
not accepting the above articles and/or reason for abolishing the century old
systems, officials responsible for doing all such things, and the alternative
arrangements made to ensure safe delivery of articles to foreign countries by
pos. He also wanted Xerox copies of official records/orders in connection
with this.
2. The information was denied by the CPIO vide letter dated 18.03.09 while
intimating that the Foreign Articles are booked at Bowbazar PO and Writers
Building PO as the service of the same has not been withdrawn by the DOP.
But for the time being the article(s) could not be booked at the said offices
due to wanting of Bar Code Number. Not satisfied with the information, the
Applicant filed the First Appeal dated 02.04.09 reiterating all his contention
from the RTI Application.
3 The First Appellate Authority replied vide letter dated 04.06.09 rejecting the
appeal and upholding the CPIO’s decision. Aggrieved with this decision, the
Applicant filed an appeal before the CIC on 29.06.09.
4. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing on 7th September, 2009.
5. Mr. Mahendra Ram, ASP (PG), Kaushik Moitra represented the Public
Authority.
6. The Applicant was not present during the hearing.
Decision
7. The Commission noted from the Respondent’s submission that all available
information has been furnished to the Appellant. With regard to the
Appellant’s complaint regarding delay in supply of information, the
Respondent stated that the explanation has already been sent to the
Appellant vide letter dated 20.05.09. He informed the Commission that the
letter was returned twice to the Post Office after it was dispatched, each time
due to the wrong name being written inadvertently by the Postman delivering
the letter. In the light of the above submission the Commission holds that
information has been provided to the Appellant and accepts the explanation
given for the delay in furnishing the information as reasonable and condones
the delay in furnishing of information.
8. The appeal is accordingly disposed off.
