Background

1. The applicant filed an RTI application dt.11.12.08 with the CPIO, AIIMS. He
requested for the following information with regard to the disease Scolliosis
for the last three years including number of patients registered, numbers
operated upon, number of patients admitted to the General ward and then
operated and finally the numbers who were operated being admitted to the
Special ward. The CPIO replied on 1.1.09 providing information about OPD
admissions, in-patient hospitalization and the number of operations for the
year 205,2006 and 2007.. Not satisfied with the reply, the Applicant filed an
appeal dated 27.1.09 reiterating his request for the information. On not
receiving any reply from the First Appellate Authority, the Applicant filed a
second appeal dt.2.3.09 before the CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for May 4, 2009.

3. Dr. D.K. Sharma, Medical Superintendent & CPIO represented the Public
Authority.

4. The Applicant was not present during the hearing.

Decision

5. The Respondent submitted that the AIIMS does not maintain records disease
wise but maintains the same departmental specialty wise. Accordingly, the
statistics in respect of the Orthopedics Department has been provided to the
Appellant. The Respondent further added that identifying cases of the said
disease from all the OPD cases would result in disproportionate diversion of
the resources of the Institute since the total OPD admissions over the three
years runs into lakhs of patients and the actual numbers operated into several
thousands. In such a situation, the Appellant is advised to cut down on the
volume of information he requires and the CPIO to allow inspection of files
based on the revised request in order to enable the Appellant to identify the
cases of patients who have undergone operations, for himself. The certified
copies of the information requested by the Appellant after inspection may be
provided after ensuring the names and particulars and other personal details
of the patients are severed from the record as provisions under Section 10(1).
The information may be provided within 30 days of the date of issue of this
Order.

6. The appeal is disposed off.
