Background
1. The Applicant filed his RTI Request on 25.08.2009, with the PIO North Western Railway,
Jodhpur, seeking certified copies of Recruitment Rules of letters, orders etc. as also
specific information about Shri Babu Singh, Divisional Secretary of N.W.R.E.U of Jodhpur
Division. The PIO replied on 02.09.2009 stating that the Card Pass No 076895 issued to
Shri Babu Singh, DS has already been returned to GM (P) NDLS, receipt of which he
enclosed along with his reply. He stated that that the copy of the Card Pass No. 076895
is not available in the office. He also provided a copy of the letter dated 18.06.2009 is
submitted. The Pio informed the Applicant that any further information regarding car
pass may be obtained from GM (P) NDLS. Information was also provided by the Jodhpur
Office against Points 1 to 4 and 6 to 8 and by the Jaipur Office against point 5 . the PIO
Jaipur informed the Applicant against point 9 that Mr. Babu is on deputation with
R.E.C.B.S. Still not satisfied, the Appellant filed his First Appeal on 28.10.2009
commenting on the information. The First Appellate Authority replied on 16.11.2009
directing the PIO to provide the missing information against point 9 within 10 days
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
for May 7, 2010.
3. Mr. Ashok Kumar Mehta, APIO, Mr. M.K. Sharma, APIO, and Mr. Dilip Vyas, Dy. CPO
represented the Public Authority.
4. The Appellant was present during the hearing.
Decision
5. The Commission after hearing both sides and on perusal of information on record, with
regard to point 5, directs the PIO to allow inspection of files dealing with the issue of the
Union Card Pass issued to Mr. babu. With regard to point 9, the Appeal is being
remanded to the Appellate Authority to ensure that his order is complied with by the PIO.
The Commission after hearing both sides directs the Deemed PIO to provide the
information against point 6. Information to be provided by 10.6.10
6. The appeal is accordingly disposed of.
