Facts

arising from the Complaint:

Mr. C. K. Rejimon had filed a RTI application with the PIO-GNCTD, PWD, MSO
Building, Floor no.12, I.P. Estate, New Delhi on 10/03/2009 asking for certain information.
Since no reply was received within the mandated time of 30 days, he had filed a complaint under
Section 18 to the Commission on 01/08/2009.

The Commission issued a notice to the PIO on 27/09/2009 asking him to supply the
information by 21/09/2009 and sought an explanation for not furnishing the information within
the mandated time. The PIO-GNCTD, Engineer in Chief, PWD, MSO Building, New Delhi has
informed the Commission on 11/09/2009 that the RTI application dated 10/03/2009 had already
been transferred to the PIO-EE PWD, M-111(NCTD), RR Lines, Ring Road, New Delhi on
18/03/2009 U/s 6(3) of the RTI Act, 2005.

The PIO-EE PWD, M-111(NCTD), RR Lines, Ring Road, New Delhi has informed the
Commission vide a letter dated 19/09/2009 that the information has been sent to the Complainant
on 30/05/2009. A perusal of papers submitted by the PIO it appears that the information supplied
to the Complainant is incomplete reason being in reply of Query no. (1) (b) to (g) the PIO
informed that the road had been transferred to his office in April 2007, so the records before
April 2007 are not with his office.

Therefore the PIO is directed to supply the complete information and if the information
required is held by any other officer with the same public authority then the PIO may seek the
assistance of that other officer as he or she considers it necessary under Section 5(4) of the RTI
Act or if the information required is held by another public authority then transfer the
Application or such part of it as may be appropriate to that other public authority and proof of
transfer of RTI Application under Section 6(3) of the RTI Act must be sent to the Complainant
and the Commission

Decision:

The Complaint is allowed.

The PIO is directed to send the information mentioned above to the Complainant and the
Commission before December 01, 2009.

Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005.
