Background
1. The Appellant filed an RTI request dt.9.10.07 with the CPIO, BSNL,
Ambala. The Appellant wanted the following information:
a. The status of disposal of his representation dt.12.7.07
b. Time set for deciding the representation as per rules along with a
copy of the rules.
c. If the time frame for deciding of representation is 30 days, then
reasons for delay of settlement.
d. Rejection letter of 1st upgradation under Time Bound Executive
Promotion policy from 1.10.04.
The Appellant filed an appeal dt.3.5.08 with the Appellate Authority
stating that the CPIO had replied on 1.12.07 informing him that his
representation would be considered by the Screening Committee. The
Appellate Authority replied on 30.7.08 enclosing a copy of the rules
regarding disposal of representation and providing some information
against points © and (d). Not satisfied with the reply, the Appellant
filed his second appeal dt.19.8.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner,
scheduled the hearing for January 19, 2009.
3. Mr. V.K. Gupta, GM(NW) and CPIO represented the Public Authority.
4. The Appellant was absent during the hearing.
Decision
5. The Respondent submitted that on 21.2.08 the Appellant was
informed that he was having more than 2 ‘Average’ entries in his ACR
in the last five years because of which his case was not considered for
promotion. Also, all information available with the Public Authority has
already been provided to the Appellant. The Commission holds that
since all the information has been provided and, accordingly,
disposes off the appeal.
