                                                   ORDER

Chander   Prakash,   the   Appellant   had   filed   an   RTI   application   dated 

23.11.2010 seeking information on 3 points.

During the hearing the appellant pointed out that the CPIO has not complied 

with the directions of the FAA, who vide his order dated 24.1.2011 directed as 

follows in respect of point No.1 & 2 of the RTI application:­

“The   CPIO   is   directed   to   collect   from   the   custodian   and   provide   the  

information for the period from 1997­1999 as sought for by the applicant in his  

application   dated   23.11.10   as   per   the   provisions   of   the   RTI   Act,   2005   in  
consideration to the appeal dated 24.12.2010 within 15 working days from the date  

of issue of this order.”

During the hearing the Respondent submits that copies of DPC Minutes and 

Promotion Orders w.e.f. 2000 onwards had already been provided to the appellant. 

Records prior to year 2000 are not available in DPC Cell as the cell was created 

only in the year 2000.  Besides, the Respondent submits that appellant inspected 

all the 28 DPC files and there is no further information available in the DPC Cell.

After hearing the parties and on perusal of relevant documents on file the 

Commission   observes   that   FAA   has   directed   the   CPIO   to   collect   requisite 

information from the custodian and provide the information to the appellant.  Under 

the circumstances, the Respondent CPIO is hereby directed to comply with the 

directions of the FAA within 15 days of receipt of this order. 

With this direction the matter is disposed of on the part of the Commission.
