Background
1. The Appellant filed his RTI application dt.7.2.08 with the CPIO,
DG:Doordarshan. He requested for information against 17 points
regarding discontinuation of telecast of 2 sponsored serials. The
CPIO(Vigilance) replied on 15.4.08 stating that information cannot be
provided as it does not constitute information in terms of Section 2(f)
of RTI Act. The Appellant filed an appeal dt.6.5.08 with the Appellate
Authority. The Vigilance Officer replied on 29.5.08 stating that the RTI
application should have been replied by CPIO (Programme wing)
instead of CPIO (Vigilance). He also stated that the original RTI
application along with the appeal has now been forwarded to
Sr.Director(Programme), DG:DD to send the requisite reply. On not
receving any reply, the Appellant filed a second appeal dt.27.10.08
before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner,
scheduled the hearing on January 22, 2009.
3. Mr. Girish Bhatt, CPIO & Sr. V.O. and Mr. S.K. Rabbani, Vigilance
Officer represented the Public Authority.
4. The Appellant was present during the hearing.
Decision
5. The Respondent submitted that they had provided point wise
information to the queries raised in the RTI request vide letter dt.
25.7.08. In response to the second appeal filed with CIC, the
Respondents once again submitted the same information to the
appellant vide letter dated 20.10.08. Since the Appellant is still
dissatisfied, the Commission directs the Appellant to inform the
Respondents what information is exactly is missing against each point
within 5 days of the receipt of this Order and the Respondents to
provide the available information within 15 days of the receipt of
details from the Appellant.
6. The appeal is disposed off.
