Background

1. The Applicant filed an RTI application dt.14.8.08 with the CPIO, DoP,
Gurgaon. He requested for name of nominee and the nomination against the
nominee in the 3 year fixed term deposit account No.378472 in the name of
his late wife. The CPIO replied on 22.12.08 stating that the form of opening
of account is not traceable in the office of Postmaster Narnaul. Not satisfied
with the reply, the Applicant filed a complaint dt.12.1.09 before the CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for March 26, 2009.

3. The Public Authority was not present during the hearing.

4. The Applicant was present along with Mr. Pradeep Kumar Gupta and Mr. Arun
Kumar during the hearing.

Decision

5. The Complainant submitted that his late wife had opened a three year fixed
term deposit in the Post Office against Account No.378472 and now that his
wife is no longer alive he wishes to confirm that his name was provided as a
nominee for the fixed deposit and also to close the account. When he
approached the Post office for the information, he was informed that the
opening form of the account was not traceable in the office of Postmaster
Narnaul. He further stated that he had already deposited the original fixed
deposit receipt along with concerned papers for closing the fixed deposit and
collecting the money on 24.11.08. However, since his nomination No. was
known to him the post office refused to pay him the amount. The Applicant
further stated that he himself had entered his name as the nominee in the
opening form and that he is aware that there is a nomination No. against his
name. However, the Supdt. of Post Offices, Gurgaon in his letter dated
22.12.08 stated that no nomination was allotted in Account No.378472 and
that since the opening account form is not traceable, the SB-3 is not available
with the Postmaster, Narnaul.

After hearing the submission put forth by the Appellant, the Commission
directs the CPIO, O/o Supdt. of Post Office, Gurgaon to locate the opening
form against the TD Account No. 378472, and provide the required
information to the Applicant within 15 days of receipt of this Order. In the
event the form is not traceable, the CPIO, O/o Superintendent of Posts,
Gurgaon to file an FIR for the same with the Police for the missing Opening
form and to locate the form and provide the information by 15th April, 2009 to
the Appellant under intimation to the Commission. The Appellant also to be
allowed to inspect the nomination registers for the relevant year in the post
Office to locate the nomination number, before 15th April, 2009.

6. The appeal is disposed off.
