Background
1. The Applicant filed his RTI application dated 30.03.09 with CPIO/ TRAI, Delhi
seeking information about the whereabouts of one M. Sanjeev Gupta having
mobile number 98910 14044. The CPIO replied on 22.04.09 denying the
information since the said information was not available with TRAI.
2. The First Appellate Authority vide his order dated 21.05.09 dismissed the First
appeal dated 05.05.09 upholding the CPIO decisions. The first Appeal by the
Applicant was dated 05.05.09. on not receiving any reply from the Appellate
Authority and being aggrieved by constant denial of information, the
Appellant filed an Appeal before the CIC on 24.06.09
3. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing on 27th August, 2009.
4. Mr. P.K. Datta, CPIO was present during the hearing.
5. The Applicant was not present during the hearing.
Decisiones
6. The Respondent stated that Vodaphone does not fall under the jurisdiction of
TRAI and that TRAI is only a regulatory and monitoring mechanism to ensure
that certain norms formulated by the Government are being adhered to by
private operators such as Vodaphone. He also stated that the information
sought by the Appellant is not available in TRAI and that the Appellant should
approach the private service provider for it since the number belongs to one.
7. The Commission upholds the decision of the CPIO and rejects the appeal.
