ORDER
Background
1. The Applicant filed an RTI application dt.24.1.11 with the PIO, DRM Office, Western Railway,
Vadodara seeking information related to the issue of the Public Authority not having issued a correct
cheque for Rs.1383/ after he had returned the original cheque . The Sr.DFM replied on 23.2.11
stating that the Applicant had returned the cheque No.503218 dt.13.8.04 for Rs.1383/ for correction
and that since this item is over six years old, the records for the same are not available to ascertain
whether a fresh cheque was issued or otherwise. Being aggrieved with this reply, the Applicant filed
an appeal dt.9.3.11 with the Appellate Authority who disposed off the same by upholding the decision
of the PIO vide his Order dt.24.3.11. Still not satisfied, the Applicant filed a second appeal dt.5.4.11
before CIC.
Decision
2. During the hearing, the Respondents submitted that since the records are not available, they are
unable to ascertain whether a fresh cheque has been issued or not. When the Commission pointed
out that information can be obtained from the Dena Bank where the Appellant is having an account,
the Appellant submitted that he is already in possession of the passbook and that no entry for the
amount of Rs.1383/ has been shown in it.
3. Since there is no record available with regard to reissue of a fresh cheque to the Appellant, no
information can be authorized for disclosure by the Commission. It is however recommended that
the PIO put the matter up to the concerned official who, based on the passbook entries, may wish to
reconsider the same.
4. The appeal is rejected and the case closed at the Commission’s end.
5. Since there is no fee at the appeal stage, the IPO No.60E 797710 is being returned herewith.
