Facts
arising from the Complaint:
Mr. Gajanand Sankla filed a RTI application with the PIO, O/o Asst. Commissioner, Food and Civil
Supplies, Gulabi Bagh, on 28/01/2010 asking for certain information. However on not having received the
information within the mandated time, a Complaint was filed under Section 18 of the RTI Act with the
Commission. On this basis, the Commission issued a notice to the PIO & Asst. Commissioner (NW), Food,
Supply and Consumer Affair, Shalimar Bagh, on 26/06/2010 issuing a direction to provide the information
to the Complainant and further sought an explanation for not furnishing the information within the
mandated time.
The Commission received a letter dated 30/07/2010 from the PIO & AC (NW), Food, Supply and
Consumer Affair, wherein it was pointed out that the said RTI Application was filed under the Delhi Right
to Information Act, 2001. On perusal of documents, this Commission observes that the RTI Application

dated 28/01/2010 has been filed in the format under the Delhi Right to Information Act, 2001 and hence
does not fall within the purview of the Right to Information Act, 2005.
Decision:
The Complaint is dismissed.
Notice of this decision be given free of cost to the parties.
